The right to withdraw within 14 days without giving a reason
If you buy as a consumer at a distance (online), Act No. 108/2024 Coll. on Consumer Protection gives you the right to withdraw from the purchase contract within 14 days, without giving a reason. You do not have to explain to us why you are returning the goods.
This right applies to consumers; for purchases on behalf of a company (under a Company ID, IČO), the conditions of withdrawal may differ.
When the withdrawal period starts
The statutory 14-day period starts on the day on which you or a third party designated by you (other than the carrier) take possession of the goods.
- For a single item: from the day you receive the goods.
- For several items in one order that are delivered separately: from the day you receive the last item.
- For goods delivered in several lots or pieces: from the day you receive the last lot or piece.
- For regular delivery of goods during a defined period: from the day you receive the first goods delivered.
The deadline is met if you send the notice of withdrawal no later than on the last day of the period. What matters is the date on which you send it, not the date on which it is delivered.
How to withdraw from the contract
Notify us of your withdrawal by an unequivocal statement. It is enough to state clearly that you are withdrawing from the contract and to identify the order. You may use our model form below, but it is not mandatory.
- Online using the “Withdraw from the contract here” function at /odstupenie/formular — it is available throughout the withdrawal period and also works for guest purchases, without signing in. We will e-mail you an acknowledgement of receipt with the content of the notice and its date and time straight away.
- By e-mail to: info@fightshop.sk
- By letter to our registered office: TERRI-M s.r.o., Mariánska 2226/2, 811 08 Bratislava — not to the store address, as the post does not deliver mail there
- In person at one of our stores during opening hours
- By phone on +421 904 316 813 (we recommend also confirming in writing)
We recommend keeping proof that you sent the notice (the e-mail or a certificate of posting) in case you need to show that you met the deadline.
Returning the goods after withdrawal
Send or hand the goods over to us no later than 14 days after the day on which you notified us of your withdrawal from the contract. The deadline is met if you send the goods on the last day of the period.
- Send the goods by courier to: TERRI-M s.r.o. (Fightshop.sk), Ivanská cesta 26, 820 01 Bratislava — not via Slovak Post (Slovenská pošta), not to a pick-up point, and never cash on delivery (we cannot accept a cash-on-delivery parcel and it will be returned to you).
- Enclose a copy of the proof of purchase and the completed form (if you use it) so that we can quickly match the return to your order.
- Pack the goods carefully so that they are not damaged in transit.
- You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their characteristics and functioning.
You can try the goods on just as you would in a bricks-and-mortar store; however, excessive use may reduce their value.
Refund and costs
Following a valid withdrawal from the contract, we will refund all payments received from you, including the costs of delivering the goods (in the amount corresponding to the cheapest standard delivery method that we offer).
- We will make the refund within 14 days of the day on which we receive the notice of withdrawal.
- We will refund the money using the same means of payment that you used, unless you have expressly agreed to a different method; you will not be charged any additional fees for the refund.
- We are not obliged to refund the payment for the goods before we receive the goods or you supply proof that you have sent them back.
The consumer bears the direct cost of returning the goods when withdrawing from the contract.
When you cannot withdraw from the contract
Act No. 108/2024 Coll. sets out the cases in which a consumer cannot withdraw from the contract. Within our product range, the following exceptions in particular may apply to you:
- Sale of goods made to your specifications, made to measure or intended specifically for one consumer (e.g. personalised gear).
- Sale of goods supplied in protective packaging that are not suitable for return for health protection or hygiene reasons and whose protective packaging has been broken after delivery (e.g. mouthguards, hand wraps and similar hygiene-sensitive goods).
- Sale of goods which, by their nature, may become inseparably mixed with other goods after delivery.
- Sale of goods that are liable to deteriorate rapidly or perish.
If you are not sure whether an exception applies to your goods, contact us before returning them at info@fightshop.sk or on +421 904 316 813.
